RESOLUTION NO. 2014-03

WHEREAS, the Common Council of the City of Eagle Butte has determined that the “2014 Election Report” heretofore published pursuant to SDCL § 9-13-6 on January 16th and 23rd, 2014, contained errors regarding the vacancies in office and the terms thereof; and

WHEREAS, said Common Council finds that a CORRECTED notice of such vacancies in office and the terms thereof must be published to substantially comply with South Dakota municipal election law and otherwise notify the public of the offices open to election on April 8, 2014; and

WHEREAS, the election of representatives to the governing body of the municipality is essential to the function and operation of the City of Eagle Butte and this Resolution is necessary for the support of the municipal government, its existing public institutions, and to provide for the 2014 annual elections; and

WHEREAS, the Common Council determines that it is required for upcoming and future municipal elections that the sequence of appointive and elective aldermanic offices be established by resolution of the governing body;

NOW, THEREFORE, BE IT HEREBY RESOLVED, pursuant to SDCL § 9-13-6 and Ordinance 1.0301, that the publication of vacancies and terms of office shall be corrected and re-published without delay once each week for the next two consecutive weeks in the official newspaper of the municipality in substantially the form of the “CORRECTED 2014

Election Report” attached to this Resolution.  BE IT FURTHER RESOLVED that the Common Council of the City of Eagle Butte hereby ratifies and establishes the sequence of aldermanic offices and the terms thereof as reflected in such “CORRECTED 2014 Election Report”.

This Resolution shall take effect immediately upon the passage hereof in accordance with SDCL § 9-19-13 unless suspended by operation of a referendum and shall be published with the “CORRECTED 2014 Election Report” as set forth above.

The governing board did establish the election date (to be established by no later than January 14th) to be the second Tuesday in April – April 8th, 2014.  The polls shall be open from 7:00 a.m. to 7:00 p.m. on April 8th.

The person in charge of the election shall be the Finance Officer and shall thereby give proper notices for the election.

The polling shall be the City Council Chambers located at 209 Main Street, Eagle Butte, SD.  The mailing address for this facility is:

An erroneous Notice of Vacancies for the Municipality of Eagle Butte was published in the West River Eagle on the following consecutive dates: 1/16/14 and 1/23/14.  Such erroneous Notice is hereby CORRECTED as follows:

The earliest date to begin circulation of petitions / earliest date to file nominating petitions is January 31, 2014.  The nominating petitions may be filed in the office of the Finance Officer between the hours of 8:00 a.m. and 5:00 p.m. mountain standard time not later than February 28, 2014.

The last day for voter registrations is March 24, 2014 at 5:00 p.m. daylight savings time.  Failure to register by this date will result in forfeiture of voting rights for the 2014 municipal election.

This CORRECTED Notice of Vacancies shall be published once per week for two consecutive weeks.

The City Of Eagle Butte Election is scheduled for April 8, 2014.
